Terms of Service

These terms govern your use of Scanpoof. In short: it's a supporting tool to help you find and fix accessibility issues — it doesn't provide legal advice or guarantee compliance, and you agree to use it lawfully.

Agreement to these terms

These Terms of Service ("Terms") govern your use of the Scanpoof platform and website (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind it.

What the Service is

Scanpoof is a supporting tool that helps your team find, understand, fix, and document web accessibility issues. It combines automated testing (based on the WCAG standard) with guided manual checks and reporting.

Not legal advice; no guarantee of compliance

Scanpoof is not a law firm and does not provide legal advice. Automated testing cannot detect every accessibility issue, and a high score or a passing scan is not a certification of, or a guarantee of, ADA, WCAG, or any other legal compliance, nor protection from a claim or lawsuit. You are responsible for your own compliance decisions. For legal questions about your obligations, consult a qualified attorney.

Your account

  • Provide accurate information and keep it up to date.
  • You are responsible for activity under your account and for keeping your credentials secure.
  • Notify us promptly of any unauthorized use.

Acceptable use

You agree to use the Service only for lawful purposes. You will not:

  • Scan or monitor websites you do not own or do not have permission to test.
  • Use the Service to break the law, infringe others' rights, or evade security controls.
  • Overload, disrupt, reverse-engineer, or resell the Service except as expressly permitted.
  • Misrepresent scan results or use our reports to make false compliance claims.

Plans, trials, and billing

Paid plans and any free trial are described at sign-up and on our pricing page. We bill by invoice and do not store payment-card details. Plan features and prices may change; we will give reasonable notice of material changes. Unless stated otherwise, fees are non-refundable except where required by law.

Your content and data

You retain ownership of the site data and content you submit. You grant us the limited license needed to operate the Service — for example, to fetch your public pages, run scans, and generate your reports. We handle your data as described in our Privacy Policy.

Our intellectual property

The Service, including its software, design, and content (excluding your data), is owned by Scanpoof and its licensors and is protected by law. These Terms do not grant you any right to our trademarks or branding.

Third-party sites

The Service fetches and reports on third-party websites you designate. We are not responsible for the content, availability, or practices of those sites.

Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will detect all accessibility issues.

Limitation of liability

To the maximum extent permitted by law, Scanpoof will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of the State of [State], United States, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state or federal courts located in [State], to the extent permitted by law.

Changes to these terms

We may update these Terms from time to time. We will update the effective date and, for material changes, take reasonable steps to notify you. Continued use after changes take effect means you accept the updated Terms.
