Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and Scanpoof ("Scanpoof", "we", "us"), and govern your use of the Scanpoof platform and website (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind it.

What the Service is

Scanpoof is a supporting tool that helps your team find, understand, fix, and document web accessibility issues. It combines automated testing (based on the WCAG standard) with guided manual checks and reporting.

Not legal advice; no guarantee of compliance

Scanpoof is not a law firm and does not provide legal advice. Automated testing cannot detect every accessibility issue, and a high score or a passing scan is not a certification of, or a guarantee of, ADA, WCAG, or any other legal compliance, nor protection from a claim or lawsuit. You are responsible for your own compliance decisions. For legal questions about your obligations, consult a qualified attorney.

Your account

Acceptable use

You agree to use the Service only for lawful purposes. You will not:

• •Scan or monitor websites you do not own or do not have permission to test.
• •Use the Service to break the law, infringe others' rights, or evade security controls.
• •Overload, disrupt, reverse-engineer, or resell the Service except as expressly permitted.
• •Misrepresent scan results or use our reports to make false compliance claims.

Plans, trials, and billing

Paid plans and any free trial are described at sign-up and on our pricing page. Payments are processed by a third-party payment processor, and we do not see or store your full card number; some accounts are billed by invoice instead. Monthly plans renew each month and annual plans renew every twelve months at the discounted rate shown on our pricing page, until you cancel. You can cancel at any time from the Billing page; cancellation takes effect at the end of the period you have already paid for. Plan features and prices may change; we will give reasonable notice of material changes. Unless stated otherwise, fees are non-refundable except where required by law.

One free trial per website. A website (with or without "www.") can be registered to only one account, and a new account or email address does not start a new trial for a site that has already had one.

Using your own AI key

You can add your own API key from a supported AI provider (currently DeepSeek or OpenAI) so that AI Fix runs on your key instead of one of our paid tiers. We use the key only to write fixes and alt text for the sites in your account. You are responsible for the charges your AI provider makes for that use and for keeping the key valid. If the key stops working, AI Fix pauses; we do not switch to our own key. You can remove the key at any time from the Billing page, and it stops being used immediately. Suggestions written by AI are not legal advice and are not guaranteed to be correct, so review them before you rely on them.

Fixes applied by the WordPress plugin

The Scanpoof WordPress plugin carries the accessibility fixes it applies. We do not edit your posts, pages, media library, or theme files: the plugin adds its fixes to your pages as they are shown, and keeps a record of what it adds.

Fixes are shown only while the plugin is installed and active, your site is activated, and your subscription or trial is current. If you deactivate or remove the plugin, release your site's key, or your trial ends without a subscription, the fixes stop showing and your site returns to its original state. If a paid subscription is suspended (for example, for non-payment), fixes keep showing for a 14-day grace period and then pause; if you subscribe again, they return.

Before fixes pause we tell you by email and in your WordPress admin, and you can download the full list of fixes at any time to apply them yourself. When fixes stop showing, your site may be less accessible, which can increase your legal risk; you remain responsible for your site's accessibility.

Your content and data

You retain ownership of the site data and content you submit. You grant us the limited license needed to operate the Service — for example, to fetch your public pages, run scans, and generate your reports. We handle your data as described in our Privacy Policy.

Our intellectual property

The Service, including its software, design, and content (excluding your data), is owned by us and our licensors and is protected by law. These Terms do not grant you any right to our trademarks or branding.

Third-party sites

The Service fetches and reports on third-party websites you designate. We are not responsible for the content, availability, or practices of those sites.

Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will detect all accessibility issues.

Limitation of liability

To the maximum extent permitted by law, Scanpoof will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of the United States and of the state in which our company is organized, without regard to conflict-of-laws rules. The exclusive venue for disputes will be the state or federal courts located in that state, to the extent permitted by law.

Changes to these terms

We may update these Terms from time to time. We will update the effective date and, for material changes, take reasonable steps to notify you. Continued use after changes take effect means you accept the updated Terms.
